If whatever mobile machinery has seat belts required by law, the driver and subsequent passengers should make sure they utilize the belts whenever the vehicle is in motion or engaged in operation in view of the fact that this could cause the equipment to become unbalanced and therefore, unsafe.
If a seat belt or different operator restraint is required on a lift truck.
While working a forklift, the seat belt requirements would depend on a number of factors. Contributing factors to this determination may include whether the the lift truck is outfitted together with a Rollover Protective Structure, the type of forklift itself and the year the lift truck was manufactured. The manufacturer's instructions and the requirements of the applicable standard are referenced in the Regulation.
In the case of powered industrial forklifts, ANSI Standard ASME B56.1-1993 refers to a driver restraint device, system, or enclosure. An operator restraint device, system, or enclosure is intended so as to help the operator in lessening the probability of entrapment of the torso and/or head between the truck and the ground in the event of a tip over. The restraint device or system can comprise a seat belt, while a seat belt is not necessarily a part of such machine or system.
